1. Agreement to terms

These Terms of Service ("Terms") form a legally binding agreement between you ("you", "customer") and UNDER x PERFUME ("we", "us", "our") governing your access to and use of underxperfume.com (the "Site") and any purchase you make. By accessing the Site, creating an account, or placing an order, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, Shipping Policy, and Return & Refund Policy, which are incorporated by reference. If you do not agree, do not use the Site.

2. Definitions

• "Products" — the fragrances and related goods we offer for sale.
• "Order" — your request to purchase Products through the Site.
• "Content" — all text, images, logos, designs, and other materials on the Site.
• "Account" — the registered profile you may create to manage orders and addresses.

3. Who we are

The Site is operated by Chongqing wowglowing Technology Co., Ltd. (重庆沃焕科技有限公司), the company behind the UNDER x PERFUME brand. You can reach us at info@underxperfume.com for any question relating to these Terms or your order.

4. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to make a purchase. By ordering, you represent that (a) you meet this requirement, (b) the information you provide is accurate and complete, and (c) you are authorized to use the payment method you select. We may refuse service, close accounts, or cancel orders if we reasonably believe these requirements are not met.

5. Accounts

You may browse and check out as a guest, or create an Account. You are responsible for keeping your login credentials confidential and for all activity under your Account. Notify us immediately of any unauthorized use. We may suspend or terminate Accounts that violate these Terms or that we reasonably believe are involved in fraud or abuse.

6. Products & availability

• We try to display Products, colors, and descriptions as accurately as possible, but screens vary and scent is subjective; minor differences in color, packaging, and scent perception are normal and not defects.
• All Products are subject to availability. We may add, change, limit, or discontinue any Product at any time without liability to you.
• We may set limits on quantities purchased per order, per person, or per household.

7. Pricing, currency & taxes

• All prices are shown in US Dollars (USD) unless stated otherwise and may change at any time without notice.
• Despite our efforts, pricing or typographical errors may occur. We reserve the right to correct any error and to cancel any Order placed at an incorrect price, even after the Order is confirmed; in that case we will refund any amount charged.
• Prices shown do not include shipping, import duties, taxes, or customs fees unless expressly stated. Any such charges that apply are described in our Shipping Policy and, where not collected at checkout, are the recipient's responsibility.

8. Orders & order acceptance

Your Order is an offer to purchase. All Orders are subject to our acceptance. An order-confirmation email acknowledges that we received your Order; it does not constitute acceptance. A binding contract is formed only when we dispatch the Products. We may, at our discretion, decline, limit, or cancel any Order — including for suspected fraud, payment issues, stock errors, pricing errors, or shipping-restriction reasons — and will refund any payment taken for a cancelled Order.

9. Payment

• Accepted payment methods are shown at checkout. By submitting an Order, you authorize us and our payment processors to charge the total amount (Products + applicable shipping/taxes) to your selected method.
• Payments are processed by third-party payment providers; we do not store full card numbers. Your use of those services may be subject to their terms.
• If a payment fails, is reversed, or is charged back without cause, we may cancel the Order, suspend your Account, and pursue amounts owed.

10. Shipping & delivery

Delivery destinations, processing times, methods, rates, and customs/duty information are set out in our Shipping Policy. Delivery estimates are not guaranteed. Risk of loss passes to you upon delivery to the carrier, except where applicable consumer law provides otherwise. You are responsible for providing a complete, accurate shipping address.

11. Returns, refunds & cancellations

Returns, refunds, exchanges, and cancellations are governed by our Return & Refund Policy. Because fragrances are hygiene-sensitive, opened or used items generally cannot be returned. Nothing in these Terms removes any non-waivable statutory rights you have as a consumer.

12. Promotions & discount codes

• Discount codes, promotions, and gift offers are subject to their specific terms, cannot be combined unless stated, have no cash value, and may be modified or withdrawn at any time.
• We may void orders or codes obtained through error, fraud, resale, or other abuse.

13. Reviews & user content

• If you submit a review or other content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and adapt it in connection with our business.
• You confirm the content is your own, accurate, and not unlawful, defamatory, infringing, or misleading. Fake or incentivized reviews that misrepresent a genuine experience are prohibited.
• We may moderate, decline, edit for length, or remove any submitted content, and reviews are published only after moderation.

14. Intellectual property

All Content on the Site, including the "UNDER x PERFUME" name, logos, product names, images, copy, and design, is owned by or licensed to us and is protected by intellectual-property laws. We grant you a limited, revocable, non-transferable license to access the Site for personal, non-commercial use. You may not copy, scrape, resell, frame, or create derivative works from the Content without our prior written permission.

15. Acceptable use

You agree not to: (a) use the Site for any unlawful or fraudulent purpose; (b) attempt to gain unauthorized access to the Site, accounts, or systems; (c) introduce malware or interfere with the Site's operation; (d) use bots, scrapers, or automated means without permission; (e) resell Products without authorization; or (f) infringe others' rights. We may restrict or terminate access for violations.

16. Fragrance safety & disclaimers

Fragrances contain ingredients (including alcohol and aroma compounds) that may cause skin sensitivity or allergic reactions in some people. Our Products are cosmetic, not medical, and make no therapeutic claims. We recommend a patch test before full use, keeping Products away from eyes, flames, and children, and discontinuing use if irritation occurs. Except as required by law, Products and the Site are provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability and fitness for a particular purpose.

17. Third-party links & services

The Site may link to or rely on third-party services (e.g., payment, shipping, analytics, social media). We are not responsible for the content, policies, or practices of third parties, and your use of them is at your own risk and subject to their terms.

18. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of the Site or any Product. Our total aggregate liability for any claim relating to a Product or Order is limited to the amount you actually paid for that Product or Order. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

19. Indemnification

You agree to indemnify and hold harmless UNDER x PERFUME and its affiliates, officers, and employees from any claims, damages, or expenses (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the Site, or your violation of any law or third-party right.

20. Governing law & disputes

These Terms are governed by the laws applicable at our principal place of business, without regard to conflict-of-laws rules, and without limiting any mandatory consumer-protection rights of your country of residence. Before bringing any formal claim, you agree to first contact us at info@underxperfume.com so we can try to resolve the matter informally. If a dispute cannot be resolved, it will be handled by the competent courts of our place of business, unless mandatory law gives you the right to bring proceedings elsewhere.

21. Changes, severability & contact

• Changes: We may update these Terms; the "Last updated" date shows the current version. Material changes take effect when posted, and your continued use means acceptance.
• Severability & waiver: If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver.
• Entire agreement & assignment: These Terms, with the policies referenced above, are the entire agreement between us. You may not assign them without our consent; we may assign them in connection with a merger or sale.
